Coming from the comprehensive reading in the Ecuadorian legal system, the scope of the right to adoption by non-heterosexual people in Ecuador is not clear. Derived from this, there have been two possibilities that, at least initially, would seem to beantinomies regarding whether or not there really is a ban. Both discussions would seem to be related to the clash between the constituent will embodied in the carta magna and a norm of the constitutional block. The present work will analyze what is related to the adoption by same-sex couples and the possible interpretive analysis between the clash of the constituent will and the fundamental rights of the people.
