Taxation in the Ecuadorian music industry: regulatory gaps, challenges, and tax incentives.

The Ecuadorian legal framework lacks a tax regime that considers the needs inherent to artistic activity. This study examines the shortcomings of the current regulations and compares them with innovative foreign laws and policies designed to support cultural sectors more effectively. Building on this regulatory gap, the research explores potential solutions to challenges such as informality, limited traceability, and irregular income commonly present among artists. Using a methodology focused on the purpose and objectives of tax policy, the analysis identifies ways to adapt the fiscal system to the realities of artistic work while promoting fairness, administrative simplicity, and economic stability. Finally, the study proposes a regulatory reform establishing a new regime capable of recognizing the fluctuating nature of artistic income and offering adequate treatment that encourages professionalization, reinforces tax compliance, and strengthens sustainable cultural development within Ecuador’s contemporary institutional and economic environment, ensuring long-term sectorial growth and resilience in Ecuador.
