Maintenance Obligations Toward Persons with Disabilities in Ecuadorian Labor Law: The “Elephant in the Room” of Reinforced Labor Protection

This paper analyzes the evolution of reinforced labor protection in Ecuador regarding maintenance obligations toward persons with disabilities. It shows that the lack of normative clarity in the former Organic Law on Disabilities led to divergent interpretations between the Constitutional Court and the National Court of Justice, particularly concerning the employer’s prior knowledge. Subsequent reforms, including the new law, administrative regulation, and recent constitutional jurisprudence, have not resolved these tensions but instead reveal a structural problem. The paper argues that the expansive interpretation of this regime has generated legal uncertainty, highlighting the need for legislative development to ensure coherent application.
